Terms of Service

Please read these Terms of Service ("Terms") carefully before purchasing a service from Pollitago ("we," "us," or "our"). By purchasing a service, you agree to be bound by these Terms.

1. Description of Service

Pollitago provides on-demand website performance testing and user simulation services. Our "Load Testing" services (Starter, Pro, Enterprise) simulate heavy user traffic to identify server bottlenecks. Our "Real User Simulation" service simulates realistic browser behavior to test analytics. We deliver our findings in a PDF report.

2. Payments and Refunds

All services are billed as a one-time fee through our secure payment processor, Stripe. Due to the digital nature of the service and the labor involved in generating and analyzing test results, all sales are final. No refunds will be issued once a test has been conducted and a report has been generated.

3. ⚠️ YOUR RESPONSIBILITIES (IMPORTANT)

This is the most critical section of our agreement.

• You must have authorization. By ordering a service, you represent and warrant that you are the legal owner of the website you provide for testing OR you have obtained explicit, written permission from the owner to conduct a performance test.
• Testing on Production Servers. Load testing, by its nature, simulates an attack. Running a test on a live "production" server can cause it to slow down or crash, impacting real users. We highly recommend running tests on a "staging" or development environment.
• You Assume All Risk. If you choose to test a production server, you do so at your own risk and assume all responsibility for any service degradation, downtime, or negative impact to your business.

4. Prohibited Use

You may not use our service for any malicious purpose. You may not order a test on a website you do not own and for which you do not have permission. Using our service to intentionally disrupt, attack, or harm a third-party website is strictly prohibited and illegal.

5. ⚠️ LIMITATION OF LIABILITY

Our service is provided "as is." In no event shall Pollitago or its owners be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, lost profits, data loss, or business interruption) that result from the use of, or inability to use, our service. This includes any server crashes, database corruption, or other damages that may occur during a test, even if we were advised of the possibility of such damage.

Our total liability to you for any and all claims shall not exceed the amount you paid for the service.

These Terms shall be governed by the laws of [Your State/Country], without regard to its conflict of law provisions.
